A 27-year-old Cheyenne man charged with attempted enticement of a minor has waived his right to a preliminary hearing.

Christopher Lee Martinez appeared before U.S. Magistrate Judge Kelly H. Rankin in Cheyenne this (Thursday) afternoon.

"He's not a flight risk," Martinez's attorney, Dion Custis, told the court. "He has a home with his wife and three children. He does not need to be incarcerated."

Judge Rankin agreed that Martinez was not a flight risk, but "could not make the finding" that he presented no danger to the community and ordered Martinez remain in custody while the case is pending.

"The case against you is a strong one," Judge Rankin told Martinez.

A criminal complaint alleges Martinez responded to an advertisement for "Fresh CFD Taboo" on a classifieds website on July 22 and arranged to meet a 12-year-old girl for sex.

Unbeknownst to Martinez, the ad was part of an undercover operation and he was actually communicating with special agents.

Martinez is facing 10 years to life in prison if convicted. His arraignment date has yet to be scheduled.
