
Man Sues Kroger and Del Monte Over “Exploding” Jar
More frivolous lawsuits…just what the world needs.
A man says he was knocked unconscious and suffered serious eye damage after the lid exploded off a jar of fruit and hit him in the face. His lawsuit is against Del Monte Foods and Kroger. The companies say that there is no evidence that the jar was unsafe, but they offered the guy $150,000 to settle out of court.
Darryl Alexander and his wife refused the settlement offer and their lawyer says $150,000 is not a high enough number because Darryl suffered permanent eye damage.
The couple alleges the peach, pear and pineapple blend was in a defective container and claims Kroger violated its "statutory duty" by selling "mixed fruit that is injurious to health," according to the suit.

Here is where I get upset…this guy doesn’t know how to open jars so he’s probably going to be rich. This wasn’t a rogue jarred fruit explosion that came out of nowhere. The guy couldn’t get the lid off of the jar so he allegedly sunk the jar in warm water (Which, if you’re not aware of the physics, warms up and expands the jar's contents creating pressure). He then started hitting it with a screwdriver. That’s when the lid popped off and hit him in the face.
Maybe there is more to the story and he has more of a case than appears on the surface, but I don’t think he should become a millionaire because he hurt himself. Blaming a company with deep pockets for your lack on foresight just ain't right. But, it’s the new American dream I guess.
Opening jars, spilling coffee… these things do not SHOULD not make you rich. They should be the kind of things you look back on in your life and say, “Man, that was dumb.”
