Avila has been charged with menacing students and possession of a weapon on school  grounds after she told police that her daughter was being menaced and bullied at school. Her court appearance is scheduled for Thursday where she will be told of any additional charges. She is in custody with a $50,000 bond.

According to the Denver District Attorney four girls 13-14 were confronted in the Lake Middle School parking lot last Thursday. Avila began arguing with the girls about bullying and reportedly showed the girls a black semi-automatic weapon saying "look what I have." The girls backed away from the confrontation and later called police and notified other adults.

This confrontation happened just one day prior to the elementary school shooting in Newtown, Connecticut.
