We have all done this. You go up to the counter of a fast food restaurant and you ask for a cup just for water and when you go to fill it up, you might sneak a little soda in it.  You don't usually want a lot of soda and you don't want to pay for something that you might not finish. Apparently that is cause to be arrested in Florida.

A Florida man is facing a felony theft charge after he got a water cup at McDonald's,  filled it with soda and then left. The Managers said that the 52-year- old man asked for a glass of water, then filled it with soda and sat outside. The manager tried to get the man to pay the $1 dollar charge for the soda and leave the premise but the man refused.

While his charge is petty theft, because of previous petty theft convictions, the charge for drinking the unpaid-for soda was increased from a misdemeanor to a felony, the arrest report shows. In Florida, a third-degree felony can result in a sentence of up to 5 years in prison and a $5,000 fine.

He also faces additional fines for trespassing and disorderly intoxication.
